CONDOMINIUM BY-LAWS:
The Condominium
Corporation (CC) relies on the By-Laws to govern, manage and administer
the Units, the Common Property and the CC's property.
Besides determining the procedure for the orderly carrying on of the
CC's business, they also contain restrictions on the use of the Units
and the Common Property and usually empower the CC with certain rights
and powers. The By-Laws
operate like a contract that binds the CC and all Owners as if each
Owner had signed the By-Laws. Specific provisions are usually
contained in the By-Laws respecting how they can be enforced and the
repair and maintenance obligations of Unit Owners and respecting the
Common Property. By-Laws
can be amended by a special resolution of the Owners which means it
requires 75% of all Owners who must vote at least 7,500 of the 10,000
Unit Factors in favour of the by-law change.
Most By-Laws provide that the powers and duties of the CC are vested in
and carried out by the Board of Directors.
